(the purpose)

Article 1

1. This regulation, based on Article 53 of the Tohoku Gakuin University Academic Regulations and Article 34 of the Tohoku Gakuin Graduate Schools School Academic Regulations, establishes necessary matters concerning the disciplinary action of Tohoku Gakuin University (hereinafter referred to as "the University") students, with the aim of maintaining a sound educational and research environment and order at the University.

Article 2

1. In these regulations, "student" refers to undergraduate students, Graduate Schools students, non-degree students, special auditing students, research students, and international students.

(Principles of Disciplinary Action)

Article 3

1. Disciplinary action must be taken appropriately and fairly, based on educational considerations for students, in order to maintain the educational and research environment of this university, and those with disciplinary authority must not abuse their power.

(Handling of disciplinary record)

Article 4

1. Disciplinary action records will not be included in documents issued according to the university's format.

(Person with Disciplinary Authority)

Article 5

1. Disciplinary action against students is taken by the university president.

(Grounds for disciplinary action)

Article 6

1. If a student falls under any of the following categories, disciplinary action as stipulated in the following article will be taken, taking into consideration educational considerations, extenuating circumstances, etc.
   1. When a student violates the regulations of this university without justifiable reason.
   2. When an individual engages in acts of violence, harassment, or other conduct that disrupts public order on campus.
   3. When cheating occurs during an examination.
   4. When a student commits any other misconduct that goes against their duties as a student.
2. The application of item 3 of the preceding paragraph shall be in accordance with the regulations concerning disciplinary actions and measures against persons who commit misconduct in examinations at Tohoku Gakuin University.

(Types of disciplinary action and the nature of the punishment)

Article 7

1. Disciplinary action shall be as specified in each of the following items, according to the type of action taken:
   1. A warning or admonition is issued in writing.
   2. Fixed-term suspension: Suspension from school for a fixed period of up to six months.
   3. Indefinite suspension: Suspension from school for more than six months, without specifying a period.
   4. Expulsion from school: Depriving a student of their student status.
2. In accordance with Article 53, Paragraph 2 of the school regulations, if the period of suspension is three months or longer, the suspension period shall not be included in the period of study.
3. Notwithstanding the provisions of paragraph 1, item 3, after six months have elapsed since the indefinite suspension, the disciplinary action may be lifted, taking into consideration the degree of remorse shown by the student subject to the disciplinary action (hereinafter referred to as "the student"), their motivation to study, etc.
4. During the suspension period specified in paragraphs 2 and 3 of Article 1, the student shall be prohibited from attending classes, participating in extracurricular activities, and taking designated examinations, etc.
5. Students who repeatedly commit similar misconduct will be subject to more severe penalties.
6. Paragraph 1, Item 4 shall apply when the degree of the misconduct listed in the preceding article is particularly severe and it is inappropriate to keep the student at the university.

(Stay at home)

Article 8

1. The university president may order the student to stay home until a disciplinary action is decided. In this case, the period of home confinement shall be included in the period of study.

(Request for reconsideration)

Article 9

1. If a student is dissatisfied with a disciplinary action, they may file a written appeal with the university president for review within 14 days from the date the disciplinary action was announced.

(Disciplinary proceedings)

Article 10

1. If a student is suspected of having committed any of the acts listed in Article 6, Paragraph 1, the President shall consult with the Tohoku Gakuin University Student Disciplinary Committee (hereinafter referred to as the "Committee"), as stipulated in the following article, regarding whether or not misconduct occurred, proposed disciplinary actions, etc.
2. The president must seek the opinion of the faculty council or graduate school committee of the department to which the student belongs or which accepts the student, regarding the committee's recommendations.
3. The committee must give the student in question an opportunity to present their case, either orally or in writing.
4. Disciplinary action against a student must be announced in writing, specifying the nature and reasons for the disciplinary action.
5. The commencement date for the disciplinary action period shall be the date on which the university confirmed the facts that led to the disciplinary action.

(Establishment of a committee)

Article 11

1. A committee will be established within the university to investigate and deliberate on disciplinary actions against students and to provide opinions to the university president.
2. Based on the President's consultation, the committee will investigate and deliberate on whether or not the student in question has committed any misconduct, propose disciplinary action, etc., and submit a written report to the President.

(Matters to be discussed by the committee)

Article 12

1. The committee will deliberate on the following matters:
   1. Investigation and fact-finding regarding fraudulent or misconduct
   2. Disciplinary action for fraudulent or misconduct
   3. Formulation of guidelines for disciplinary action
   4. Revision or repeal of disciplinary regulations, etc.
   5. Other matters deemed necessary by the committee

(Composition of the committee)

Article 13

1. The committee shall consist of the following members:
   1. Dean of Students
   2. Vice Dean of Student Affairs
   3. Student Affairs Director
   4. Two persons designated by the president from among the standing committee members as stipulated in Article 4, Paragraph 2 of the Tohoku Gakuin Educational Corporation Disciplinary Committee Regulations.
2. The committee may, if necessary, invite persons other than its members to attend and hear their opinions.

(Chairman)

Article 14

1. The committee will have a chairperson, who will be the Dean of Students.
2. In the event that the chairperson is unable to perform their duties, a committee member designated in advance by the chairperson will act on their behalf.

(Convening of the committee)

Article 15

1. The chairperson convenes the committee and presides over its meetings.

(Quorum and voting requirements for the committee)

Article 16

1. The quorum for the committee shall be two-thirds or more of its members.
2. Committee decisions shall be made by a majority vote of those present, and in the event of a tie, the chairperson shall make the final decision.

(Administrative)

Article 17

1. Disciplinary action against students and matters related to committees are handled by the Student Affairs Division of the Student Services Department.

(Revision/Abolition)

Article 18

1. Any amendment or repeal of these regulations shall be initiated by the committee, approved by the faculty council, carried out by the president, and approved by the board of directors.

Supplementary provisions

These regulations shall come into effect on April 1, 2015.

These regulations shall come into effect on April 15, 2021.
