Regulations concerning disciplinary actions and measures against individuals who engage in academic misconduct in examinations at Tohoku Gakuin University

(Purpose)

Article 1
  1. This regulation, based on Article 6, Paragraph 2 of the Regulations Concerning Disciplinary Actions Against Students of Tohoku Gakuin University, establishes the necessary matters for the fair conduct of examinations.

(Type of exam)

Article 2
  1. In these regulations, "examination" refers to the examination stipulated in Article 2, Paragraph 1 of the Tohoku Gakuin University Examination Implementation Regulations.

(Fraudulent offenders, etc.)

Article 3
  1. In these regulations, "perpetrator of misconduct" means any of the following:
    1. Those who looked at other people's answers
    2. Those who showed their answers to others
    3. Someone who wrote someone else's answer sheet.
    4. Those who had someone else write their answers for them.
    5. Someone who took an exam on behalf of another person
    6. Those who had someone else take the exam on their behalf
    7. Any person who uses an answer sheet other than the one distributed by the supervisor during the examination (hereinafter referred to as "incorrect answer sheet") to prepare an answer, or who leaves an incorrect answer sheet in a usable state.
    8. Any person who prepares an answer using materials other than those permitted to be brought into the examination (such as pieces of paper; the same applies hereinafter), or who leaves materials other than those permitted to be brought into the examination in a usable state.
    9. Those who have been permitted to bring in items (notebooks, textbooks, etc.) or other items (writing implements, etc.)
    10. Those who communicated with each other during the examination using language, actions, mobile phones, or other means of communication for the purpose of preparing their answers.
    11. Any person who has written on the campus facilities and equipment, or on the examinee's body, clothing, writing instruments, etc., for the purpose of preparing an answer, and any person who has used such writing to prepare an answer.
  2. Any conduct prohibited by this Article shall be deemed to be academic misconduct, even if such conduct does not immediately help in preparing the answers for the relevant examination subject.

(Disciplinary action and measures against those who commit misconduct)

Article 4
  1. Those who engage in misconduct will be disciplined in accordance with Article 53 of the Tohoku Gakuin University Regulations (hereinafter referred to as "the Regulations").
  2. For those who engage in academic misconduct during designated examinations and supplementary examinations, all scores on all designated examinations and supplementary examinations taken during that semester will be reduced to zero.
  3. For those who cheat during retake exams, all scores on all retake exams taken during that semester will be reduced to zero.
  4. The commencement date for the disciplinary period for those who have committed misconduct shall be the date on which the Tohoku Gakuin Student Disciplinary Committee (hereinafter referred to as the "Disciplinary Committee") confirms the facts that constitute the grounds for disciplinary action.
  5. Regarding the suspension stipulated in paragraph 1, the student ID number of the person who committed the misconduct will be clearly indicated and publicly announced within the university.

(Procedures for deciding on dispositions and measures)

Article 5
  1. The Disciplinary Committee shall investigate and verify the facts of any misconduct committed by the student invigilator, academic affairs committee member, and student committee member involved in handling the matter.
  2. Based on the facts confirmed in the preceding paragraph, the Disciplinary Committee will review the disciplinary action and measures to be taken against the student in question and submit a report to the President.
  3. The university president will seek the opinion of the faculty council of the department to which the student belongs (including the faculty that accepted the student) regarding the report from the disciplinary committee.
  4. The president shall take the opinions mentioned in the preceding paragraph into consideration when deciding on disciplinary action and measures.

(Disciplinary action against those who disrupt the exam)

Article 6
  1. In these regulations, "examination disruptor" refers to any of the following persons, who will be subject to disciplinary action in accordance with Article 53 of the school regulations.
    1. Those who interfered with another person's exam
    2. Those who obstructed the examination process
  2. The preceding two articles shall apply mutatis mutandis to the disciplinary action against those who disrupt examinations.

(Administrative)

Article 7
  1. All matters related to these regulations will be handled by the Student Affairs Division of the Student Services Department.

(Revision/Abolition)

Article 8
  1. Any amendment or repeal of these regulations shall be initiated by the Disciplinary Committee, approved by the Faculty Council, carried out by the President, and approved by the Board of Directors.
Supplementary provisions
These regulations shall come into effect on April 1, 2018.
