Regulations concerning the prevention and countermeasures against harassment at Tohoku Gakuin Educational Corporation

(the purpose)

Article 1
  1. Tohoku Gakuin Educational Foundation (hereinafter referred to as "the Foundation"), as an institution that provides character education based on Christian principles in accordance with its founding spirit, respects individual dignity and fundamental human rights. From this standpoint, it establishes a system and measures to prevent all forms of harassment that harm an individual's personality or dignity and hinder the formation of a good educational, research, and work environment, and to respond appropriately when problems arising from harassment occur.

Article 2
  1. In these regulations, the meanings of the terms listed in each of the following items shall be as defined in each respective item.
    Sexual harassment
    Sexual conduct against the will of the other party, or the other party's response to such sexual conduct, that causes harm to the other party, or acts that harm the educational, research, or work environment within the institution through such sexual conduct.
    Power harassment
    Actions that, based on a superior-subordinate relationship in the workplace, exceed the appropriate scope of work, causing physical or mental distress to the other party, or worsening the working environment within the hospital.
    Academic Harassment
    Acts that unfairly exploit a superior relationship in academic, research, or professional matters to infringe upon the other party's rights in academic, research, or professional matters, or that hinder the other party's motivation for academic, research, or professional activities, thereby harming the educational and research environment within this institution.
    Harassment
    In addition to the acts listed in the preceding three paragraphs, any inappropriate act that infringes upon an individual's personality or dignity and hinders the formation of a good educational, research, or work environment within the hospital.
    Staff
    This includes all educational staff and all employees working at this institution, regardless of whether they are full-time or part-time, who are engaged in educational and research activities at this institution (including those dispatched to this institution under contracts such as outsourcing).

(Responsibilities of this institution)

Article 3
  1. In order to prevent harassment and to appropriately address problems arising from harassment, this institution will continuously conduct awareness-raising activities for staff and students (hereinafter referred to as "members") regarding the problematic nature of harassment and the significance of harassment prevention measures, and will take appropriate measures in the educational, research, and work environments.

  1. Members of this institution must strive to create and maintain a healthy educational, research, and work environment free from harassment.

(Dealing with harassment)

Article 5
  1. To address issues arising from harassment, the following institutions will be established within this hospital.
    1. Harassment counselor
    2. Harassment Prevention Committee
      1. A. Corporate Affairs Office / Tohoku Gakuin University Harassment Prevention Committee (hereinafter referred to as the "Corporate and University Harassment Prevention Committee")
      2. I. Tohoku Gakuin Junior and Senior High School Harassment Prevention Committee
      3. (c) Tohoku Gakuin Ryugaoka High School Harassment Prevention Committee
      4. E. Tohoku Gakuin Kindergarten Harassment Prevention Committee
  2. The arrangements for harassment counselors and the harassment prevention committee shall be as stipulated in the Tohoku Gakuin Educational Corporation's Regulations on Harassment Prevention Procedures.

(Measures against harassment)

Article 6
  1. If the Harassment Prevention Committee determines that a harassment incident has occurred within the Hospital and that relief for the parties involved and restoration of the disrupted environment are necessary, the Hospital shall take swift and strict countermeasures against the perpetrator of the harassment, those involved in the occurrence and escalation of problems resulting from the harassment, and relevant organizations within the Hospital, in accordance with the Hospital's internal regulations, and shall also provide prompt and appropriate relief to the victim.

(Confidentiality)

Article 7
  1. Anyone involved in the procedures for addressing harassment shall not disclose to others any information they learned in the course of their duties regarding the harassment case.

(Prohibition of disadvantageous treatment)

Article 8
  1. Members who have consulted or filed complaints regarding harassment, cooperated with fact-finding investigations under the Harassment Countermeasures Committee, or otherwise cooperated in responding to harassment shall not be subjected to any disadvantageous treatment in terms of employment or education.

(Protection of privacy)

Article 9
  1. When taking measures to prevent and address harassment based on these regulations, the Board of Education and its members must give due consideration to protecting the fundamental human rights and privacy of the parties involved.

(Revision/Abolition)

Article 10
  1. Any revision or repeal of these regulations shall be carried out by the Board of Directors after deliberation by the Corporate and University Affairs Committee.
Supplementary provisions
  1. These regulations shall come into effect on February 5, 2014.
  2. With the implementation of these regulations, the "Tohoku Gakuin University Regulations Concerning the Prevention of Harassment, etc." (established April 1, 2000, Regulation No. 5) is hereby abolished.
Supplementary Provisions (Revised No. 19, February 6, 2017)
These regulations shall come into effect on February 6, 2017.
Supplementary Provisions (Revised No. 12, February 12, 2020)
These regulations shall come into effect on February 12, 2020.
